These Terms of Service (Terms) apply when you visit or make a purchase from the Maison Lune website (Website). The Website is operated by Maison Lune Ltd (Maison Lune, we, us or our), a New Zealand company.
By using the Website or placing an order, you agree to these Terms. If you do not agree, please do not use the Website. Nothing in these Terms limits or excludes any rights you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other New Zealand law that cannot lawfully be limited or excluded.
1. About our online store
Maison Lune sells bedding, bathroom, sleepwear and related home and lifestyle products through the Website. You must provide accurate, current and complete information when placing an order. You are responsible for checking your order details, including the products, sizes, colours, quantities and delivery address, before submitting your order.
You must be at least 18 years old, or have the permission of a parent or legal guardian, to place an order. You must not use our products or Website for any unlawful purpose.
2. Product information
We take reasonable care to ensure that product descriptions, photographs, dimensions, materials, care instructions and other information are accurate. However:
· colours may appear slightly different depending on your screen, lighting and device settings;
· dimensions and measurements may have reasonable manufacturing tolerances; and
· natural fibres and handcrafted products may have minor variations in colour, weave, texture or finish. These variations are part of the character of the product and are not necessarily faults.
Product images are for illustration purposes. Accessories or styling items shown in an image are not included unless they are expressly listed in the product description.
If a product does not match its description or is not of acceptable quality, your rights under New Zealand consumer law apply.
3. Images and visual representations
We aim to display our products as accurately as possible. Some lifestyle, promotional or editorial images used on the Website or in our marketing may be digitally created, enhanced or generated using artificial intelligence. These images are provided for styling and illustrative purposes and may include items, colours, textures, proportions or surroundings that are not included with the product.
Please refer to the individual product photographs, description, specifications and “what is included” information when making a purchase. Where an image is illustrative or AI-generated and does not show the exact product being sold, we will identify this where reasonably appropriate.
Colours may also appear differently depending on lighting, photography and individual screen settings. Nothing in this section limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
4. Prices and payment
All prices displayed on the Website are in New Zealand dollars (NZD). Prices include GST where applicable, unless stated otherwise. Delivery charges and any other applicable costs will be shown at checkout before you complete your purchase.
We may change prices at any time, but a change will not affect an order we have already accepted. If a price or product information is clearly incorrect because of a genuine error, we may contact you to correct the error before accepting or fulfilling the order. You may then confirm the order at the correct price or cancel it for a full refund.
Payment must be made using one of the payment methods offered at checkout. Your payment may be processed by a third-party payment provider and will also be subject to that provider's terms and privacy practices.
5. Orders and order acceptance
Submitting an order is an offer to purchase the selected products. An automated order confirmation acknowledges that we have received your order; it does not necessarily mean we have accepted it.
We accept your order when we confirm that it has been processed or dispatch the products. We may decline or cancel an order before acceptance if, for example:
· a product is unavailable;
· the price or product information contained a genuine error;
· payment is not authorised;
· we reasonably suspect fraud, unauthorised activity or resale activity; or
· we cannot deliver to the address provided.
If we cancel an order after payment has been taken, we will refund the amount paid using the original payment method. We may apply reasonable purchase limits to products or orders.
6. Product availability
All products are subject to availability. We make reasonable efforts to keep stock information current, but an item may become unavailable after an order is placed. If this happens, we will contact you and offer an available alternative where appropriate or provide a refund for the unavailable item.
7. Delivery
We currently deliver to the locations described in our Shipping Policy. Delivery timeframes are estimates unless we expressly agree to a specific delivery date. We will arrange delivery within the agreed timeframe or, if no timeframe has been agreed, within a reasonable time.
You are responsible for providing a complete and accurate delivery address. Please contact us as soon as possible if you notice an error. We cannot guarantee that an address can be changed after an order has been processed or dispatched.
We remain responsible for ensuring that products reach you safely, as required by New Zealand consumer law. If a parcel is lost, damaged or significantly delayed, please contact us so we can investigate and provide an appropriate remedy. 8. Returns, exchanges and faulty products
Returns and exchanges are handled in accordance with our Returns and Refund Policy, which forms part of these Terms.
We are not required to provide a refund or exchange if you simply change your mind, unless our Returns and Refund Policy says that we will. Any voluntary change-of-mind return is subject to the conditions and timeframes in that policy.
If a product is faulty, damaged, unsafe, does not match its description, is not fit for a purpose made known to us, or otherwise fails a guarantee under the Consumer Guarantees Act 1993, you may be entitled to a repair, replacement, refund or other remedy. Your remedy will depend on the circumstances and the seriousness of the failure. These rights apply in addition to any voluntary returns policy we offer.

9. Promotions, discount codes and gift cards
Promotions and discount codes may be subject to additional terms displayed with the offer. Unless stated otherwise:
· offers cannot be exchanged for cash;
· only one discount code may be used per order;
· discount codes cannot be applied after an order has been placed; and
· promotions are available for the stated period and while stocks last.
If we offer gift cards, their terms, expiry information and permitted use will be clearly stated at the time of purchase and will comply with applicable New Zealand law.
10. Website use
You may use the Website only for lawful, personal shopping and information purposes. You must not:
· interfere with the operation or security of the Website;
· introduce malware, malicious code or harmful material;
· attempt to gain unauthorised access to the Website, customer information or connected systems;
· scrape, copy or commercially exploit Website content without our written permission;
· use false information or another person's identity without authority; or
· use the Website in a way that infringes another person's rights or breaches any law.
We may restrict or suspend access to the Website where reasonably necessary to protect the Website, our customers or our business.
11. Intellectual property
The Website and its content, including the Maison Lune name, logos, branding, photographs, graphics, text, product descriptions and page design, are owned by or licensed to Maison Lune and are protected by intellectual property laws.
You may view and download Website content for your personal, non-commercial use. You must not reproduce, modify, distribute, publish, sell or commercially use our content without our prior written permission, except where permitted by law.
12. Reviews and customer content
If you submit a product review, photograph, comment or other content to us, you confirm that it is truthful, relates to your genuine experience, does not infringe anyone else's rights and is not unlawful, offensive or misleading.
You give us a non-exclusive, royalty-free permission to use, reproduce and display that content for our Website and marketing, unless we agree otherwise. We may moderate or remove content that breaches these Terms or applicable law. We will handle any personal information associated with customer content in accordance with our Privacy Policy.
13. Third-party services and links
The Website may use or link to third-party services, including payment providers, delivery providers, social media platforms and other websites. We do not control third-party websites and are not responsible for their content, availability, security or privacy practices. Accessing a third-party service may be subject to that provider's own terms.
Nothing in this section limits our responsibility for suppliers or service providers where we remain legally responsible to you.
14. Privacy
Our collection, use, storage and disclosure of personal information are explained in our Privacy Policy. By using the Website, you acknowledge that your personal information will be handled in accordance with that policy and applicable New Zealand privacy law.
15. Website availability and errors
We aim to keep the Website secure, accurate and available, but we do not guarantee that it will always be uninterrupted or error-free. We may update, suspend or withdraw parts of the Website for maintenance, security or business reasons.
To the fullest extent permitted by law, we are not responsible for losses caused solely by events outside our reasonable control. Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability arising under the Consumer Guarantees Act 1993 or Fair Trading Act 1986.
16. Business purchases
If you acquire products from us for the purposes of a business, please contact us before ordering if you require trade or commercial terms. Any agreement to contract out of the Consumer Guarantees Act 1993 must be in writing and will apply only where it is fair and reasonable and legally permitted.
17. Changes to these Terms
We may update these Terms from time to time by publishing the revised version on the Website. The updated Terms will apply from the stated effective date. The Terms that applied when we accepted your order will continue to govern that order unless a change is required by law or you agree otherwise.
18. Severability and waiver
If any part of these Terms is found to be unlawful, invalid or unenforceable, that part will be read down or removed to the minimum extent necessary. The remaining Terms will continue to apply.
If we do not immediately enforce a right under these Terms, that does not mean we have waived that right.
19. Governing law
These Terms are governed by New Zealand law. You and Maison Lune submit to the non-exclusive jurisdiction of the New Zealand courts. This does not limit any right you may have to bring a claim in the Disputes Tribunal or another appropriate forum.
